كما هو معلوم أنه لا وجود ـ حديثاً ـ للدولة ما لم يكن لها دستور، ذلك الذي يحدد فيها سلطاتها، ويسبغ على هذه السلطات صلاحياتها، ويحدد الأطر التي تعمل في حياضها، دون تعد منها على اختصاصات سلطة أخرى أو صلاحياتها.ولأن الدستور هو قانون القوانين، وهو المسيطر على ما عداه من قواعد قانونية، ولأنه كذلك المنهج الذي يحدد الفلسفة السياسية والاجتماعية والاقتصادية للمجتمع، فإن من الواجب أن تنضوي كافة تشريعات الدولة تحت لوائه، مستظلة به عاملة بأحكامه، ونقول كلمة "تشريعات" دلالة على اتساع المصطلح؛ بحيث يشمل كل قاعدة قانونية، سواء كانت قانوناً أو مرسوماً بقانون أو قراراً بقانون أو لائحة، أياً كانت التسميات والأنواع، فإن أساسها يجب أن يكون دستورياً.وما تسيد أحكام الدستور على القواعد القانونية الأخرى، إلا تطبيقاً للشرعية الدستورية التي يعتبر الدستور في ظلها القانون الأسمى والأعلى، الذي تخضع كافة سلطات الدولة من تشريعية وتنفيذية وقضائية لأحكامه ومنطقه، فهوـ لهذا السبب ـ المنشئ لها المحدد لأطرها، فولادة الدستور ولادة لسلطات الدولة، وزواله يعد زوالاً لها.ولكن يجب أن يفهم أن هذه القاعدة ليست عامه، إذ أن ذلك يقتصر على الدولة القانونية التي تتخذ من القانون وأحكامه أساساً لنشأتها ووجودها، ومحركاً لحياتها اليومية.
